Deseret News picked it up, too....... Seeing this was on the South End - would love to see the news in Phoenix and LA covering it also. I saw in the comments on KSL someone complained they don't have portable toilets on all he beaches of the lake... blamed it on not enough toilets. My guess is they had a good spot, 20 people, and knew they would have to move the boat once maybe twice in the week to pump out for that many people and this was their alternative to keep their good spot and not have to move the boat til they were finished with their week.....

The sad thing is there is a pump right across the bay, down by Dominguez. They could leave their anchor lines in place and leave a ski boat there with about 10 people to reserve that spot, take the 20 minute drive across the bay, pump out, and be back. To me that's a simple task.

How do you prosecute that? How do you prove it? We all can see what happened, but the burden of proof to charge and convict someone would be a challenge.

I really don't think proving it would be difficult if it went to court which it probably wouldn't. Just slap a litany of charges on the perps and they would probably plead out. The risk would just be too great to challenge in court I believe. Besides the obvious charges available, authorities could also and perhaps more easily prove conspiracy by most if not all of the houseboat guests. Remember that conspiracy to commit a misdemeanor is a felony...or at least that is what my extensive research of watching several Dirty Harry movies over the weekend has taught me.
They have witnesses and unfortunately they have loads and loads and loads of evidence that all persons involved conspired to leave on that beach and avoid legally required disposal.
If that's not a smoking bum then I don't know what is.

Would likely be the person responsible for the boat that particular week. Given past records on events of this sort my guess is this will go nowhere.
Apparently there were multiple WITNESSES! That's how you prosecute these idiots! But, as another post indicated, NPS does not really give a S**T about maintaining the pristine lake! And probably would not take the effort to prosecute, even with overwhelming evidence! Look at all the other violations, (illegal fireworks, etc.) they ignore! They are just like all other civil service worthless taxpayer funded government employees. Harass a few law abiding citizens to justify your unnecessary bureaucratic position to perpetuate your bloated salaries until you retire, with taxpayers paying you far more than we get from the Social Security we also pay for!

The sad fact is the message this sends to future offenders. If folks know they will not be prosecuted for something this egregious, well reported, and eye-witnessed, what will discourage this behavior in the future? Those who have been going to the lake for years wonder what is prosecutable and enforced? I have been stopped at Halls Crossing for a "safety check" and ticketed for an out-of-date fire extinguisher, yet I've watched boats and jet skis blast pass the back of the houseboat within 50 feet (not wakeless) and the rangers observing this behavior and not doing anything about it. I've watched wake-boarding take place in Bullfrog Bay LONG after sunset and nothing being done about it, yet if I'm working on my houseboat after 10:00 PM I've been told it was quiet hours.
I know law enforcement has a tough job. The lack of consistency is frustrating as it seems the more dangerous and destructive behaviors go unpunished, but the smaller infractions are readily enforced on mostly law abiding citizens.

I am ready for part II of this. Exactly what did the NPS do? Has there been citations issued, has the alleged offending party been officially contacted? Tell me there is a part II and that this idiot is not out there laughing. If the NPS failed to act is there another Utah agency interested in pursuing charges for the alleged public defication convoy?
Talking about poop, is anyone else bothered by dog owners leaving the beach covered with dog poop or buried dog poop. I fully support the same $300 fine for each dog poop pile left on beaches. I will take firework trash and empty beer cans any day over dog poop and Idaho people Desert Oasis poop. Does anybody have a name of the alleged public deficators?

NPS better be doing something about this or I will blow a gasket and be the biggest a hole they've seen in a while. Witnesses observed,reported and I would guess testify so the very least the government should do is attempt a conviction. WE are responsible for OUR Lake Powell . Put whatever pressure is necessary on those responsible for following up on these egregious offenses. Where is Dirty Harry or Charles Bronson when you need them. We don't need some milquetoast.

Two people have taken direct action with one of these taking the hammer on this issue in the form of repeated direct inquiries.

You are right. I did call out a member. And I meant it. But I don't think this is the place to air things out.
I'll state my point again. If the 29 members who have commented (or RANT) conveyed the same sentiments to the proper authorities, it would be much more useful than complaining on a message board.
We did provide written witness statements to NPS. The officer did say that if charges were pursued we would be asked to testify in person in court - I don't know where that would take place. We are more than willing to show up and testify. -Doug
p.s.-I did speak to someone yesterday who specifically knows who the perpetrators are i.e. they know which partner in the HB was on the boat the week of this incident. I don't think this information is difficult to find - if NPS wants this information I'm sure they have it. If NPS doesn't have this information, I'd be happy to introduce them to someone who does have it.

Thank you Doug, I just contacted NPS and was told no information would be given to the public because it is an ongoing investigation. I would think that the citizens would at least have the right to know if this will be pursued. But I do appreciate your response.
