I beg to differ on this one. To be covered, it has to be written in. If it's not written in, it's not covered If it's not written in, and they can claim deniability and not pay out.
In a typical policy, you are covered unless there is a stated exclusion. That’s why you need to read your policy and exclusions.
 
I'd suspect something along the lines of "operating within the capacities of the vessel" are in theirs and every policy.

I think that there was a coast guard regulation about the number of people on board that would require a Captain.

Either way, I’m still not sure that would justify a denial. Having 25 people on a boat that is capable of holding 15 (just spit balling numbers) would have nothing to do with the fire.

But I’m not a lawyer. And I hope the lawyers don’t have to get involved.

Boats over 20 feet are not required to have capacity plates. Many manufacturers of pleasure and sport boats still provide them for larger boats but they are just for guidance purposes and they are not a regulatory requirement.

There is a lot of discussion of maximum number of passengers while underway being 12 without a coast guard captain license. It is my understanding that this is only applicable for charter and commercial operations. That is why houseboat rentals mandate no more than 12 onboard while the boat is under way. However, where a houseboat is part of an ownership share, it would no longer be considered a charter operation and is no longer subject to the 12 persons requirement. Individual houseboat ownership groups may have their own regulations though either imposed by insurance or self-imposed. Our current boat mandates no more than 12 persons onboard while under way, but our previous boat had no such restrictions.

My wake boat has a nameplate rating of 17 persons. I would feel far more comfortable hauling 30 people on my houseboat than 17 on my wake boat (not that I have ever done either).
 
If Length of boat is above 27’, then considered yacht certified. And limit on passengers is what you can safely carry…….Life jackets, seats, and not swamping the boat.

Life jackets available would be the biggest issue on a houseboat. Weight of the people is a minor issue. Looking at the “fluids” in the tanks on a houseboat could easily exceed 10,000#….well more then 30 people.

That's not how my insurance is looking at the lawsuit I'm going thru right now and we are even with a reputable insurance company. Not Flo or the gecko.
I wish it was because it would have been paid out over a year ago and the whole thing would be done and over with.
This LLC will probably have a long legal fight with their insurance over this.

With big payouts, insurance companies will find what ever reason they can to get from paying out. They will even go as far as to say, "It's not covered in the policy" because it's not written in. That's what mine told us.

You should get a lawyer or at the very least talk to your states insurance commissioner. It’s been a while, but I did work for an insurance company in the past.

We actually have a lawyer and we are suing the insurance company for breach of contract for coverage and non payment for the incident.
Like I said, insurance companies will go thru the policy with a fine tooth comb to find any reason to not pay these big claims. That's just what my experience is.

Yup, you are correct. I have kinda an inside 'view" because my Dad was a claims rep with a big NY firm.

He was always under pressure to deny claims. But he had an honest nature and wanted to help honest folks who'd paid their premiums, so of course he got canned at 56 years old.

IMHO, Insurance companies are like Vegas casinos.....they stay in biz by NOT paying out.....

Yup......it's......wait for it.......a 'crap' shoot.......

vegas was not built by winners. insurance companies are similar,
they fine tune the odds which always favors them.
